The program incorporates multiple inspection types that are necessary to prevent, identify, and rectify any issues related to safety, security and environmental protection.</p>
<p>The program is not intended to replace surveys for the issuance of class and statutory certificates. Such activities will continue to be performed by duly recognized organizations. Each inspection has a different purpose, but the final goal is to assist the ship owner/operator in complying with the application of international standards prescribed by a host of treaties and conventions such as Safety of Life at Sea (SOLAS) and the Marine Pollution Convention (MARPOL) as well as national regulations. The main goals of the program are to assist owners and operators to conduct their vessels safely, efficiently and cost-effectively.</p>
<p>As a continued effort to reach our goal of zero deficiencies and detentions, Dominica has also developed the Detention Prevention Program. This program entails daily monitoring of our vessels&#8217; performance and identifying vessels that are having difficulty complying with mandatory instruments. These vessels are placed in the Detention Prevention Program and additional support is provided to the owner and operator.</p>

<p>A clause in the charterparty will ensure this transfer of “ownership” of the bunkers on board. This is the “Bunkers on delivery and redelivery clause”. Naturally, each party will want to state the quantity of bunkers on board at the appropriate time and disputes can arise, especially if there is no qualification in the “bunker clauses” specifying the price to be paid by each party for the bunkers on board</p>
<p>To minimise this source of dispute between the shipowner and the charterer, independent surveyors may be employed to carry out an on-hire survey on delivery and to carry out an off hire survey on redelivery. The surveyors will sound the tanks, calculate and certify the fuel that is on board.</p>
<p>In addition to bunkers on delivery and redelivery surveyors could also be employed to survey the condition of the ship on delivery and redelivery.</p>
<p>In a time charter, the charterer is obliged to redeliver the vessel in “ . . . good order and condition, ordinary wear and tear excepted, to the Owners . . .”. The good order and condition must be the same as when the ship was delivered to the charterer. When the ship is delivered (“placed at the disposal of the Charterers”) it must be “ . . . ready to receive cargo with clean-swept holds and tight, staunch, strong and in every way fitted for the service . . . to be employed in carrying lawful merchandise . . .” (New York Produce Exchange form)</p>

<p>Each vessel sailing under the Panamanian flag in foreign service and dedicated to the international commerce and other commercial activities shall be subject to an annual safety inspection, in order to determine whether it complies with the National and International Laws and Regulations currently in force. In addition, said vessels shall be subject to special inspections whenever circumstances merit this, in order to attain the aforementioned aims.</p>
<p>The owner(s)/operator(s), charterers and others responsible for the operation of one or more vessels sailing under the Panamanian flag, as well as their agents or representatives, and the Master of such vessels shall be under obligation to admit the Inspection personnel on board, cooperate with them and allow them to fully carry out the inspection.</p>
<p>The owner or Master of a vessel who refuses the Inspection Service to whichLaw No.39 of July 8, 1976 refers, or who fails to submit the form on which the Inspection is recorded shall be subject to penalty of up to ten thousand dollars ($10,000.00).<br />In the event of reoccurrence, in addition to the penalty, there may be an immediate cancellation of the Panamanian Registry of the vessel without affecting the compliance with the obligations as set forth by the Laws of the National Merchant Marine.</p>
